About the Maximum Price Tariff
The maximum price tariffs for goods and services produced by chamber members and subject to the tariffs determined by the chambers of tradesmen and craftsmen subject to Law No. 5362 on Professional Organizations of Tradesmen and Craftsmen are prepared either at the request of members or directly.
Tariff Preparation Process
For the goods and services for which a tariff is to be prepared, the Chamber Board of Directors obtains the opinion of the relevant Professional Committee. During the preparation of the tariffs, the opinions of experts and organizations are also sought if deemed necessary.
The Board of Directors concludes applications made to the Chamber within one month at the latest and submits them to the assembly for approval. The Assembly discusses this proposal within one month at the latest and approves or rejects it. If the tariffs are rejected, the board of directors, taking into account the assembly's reasons for rejection, submits new tariffs for the assembly's approval at the first assembly meeting held after the date of rejection. The tariffs are decided at this meeting.
Tariffs approved by the assembly enter into force on the same day. The approved tariffs are notified within ten days at the latest to the Municipality, the Local Administrative Authority and the Union of Chambers of Tradesmen and Craftsmen.
Objection and Commission Process
If municipalities and the local administrative authority find the tariffs determined by the Chamber unsuitable and cannot reach an agreement with the Chamber, they may object, separately or jointly, to the commission at the local administrative authority within fifteen days of the date on which the tariffs are notified to them in writing.
The Commission decides on the objections within fifteen days at the latest from the date of application and approves or rejects them. If the tariff is rejected, the Chamber either prepares a new tariff, taking into account the commission's reasons for rejection, or lodges an objection before the court competent to hear commercial cases within ten days of the date of written notification of the commission's decision to the Chamber. The decision of the court is final.
Important:
If the commission rejects the tariffs, the tariffs determined in the previous period, if any, are applied; otherwise, the application of the tariffs is suspended.
Distribution and Inspection of Tariffs
Tariffs prepared in accordance with the "Regulation on the Arrangement of Maximum Price Tariffs for Goods and Services Produced by Merchants and Industrialists" issued pursuant to subparagraph (ı) of paragraph 1 of Article 12 of Law No. 5174 are provided for a fee to members who produce goods and services.
Whether the tariffs are kept in the places where they are required and whether these tariffs are complied with are inspected by the responsible Chamber staff. For Chamber members who act in violation, the provisions on disciplinary penalties and the provisions on monetary fines set out in the relevant articles of Law No. 5174 apply.
