Law and Regulation
The Insurance Law No. 5684 (Official Gazette dated 14.06.2007, No. 26552) and the Regulation on Insurance Agents (Official Gazette dated 22.04.2014, No. 28980) have entered into force.
Within the framework of the said law and regulation, the authority to issue certificates of conformity to insurance agents has been transferred to TOBB and the Chambers. Circular No. 2014/8 of the Undersecretariat of the Treasury, which clarifies the issues that have arisen in practice, has been published.
Our members who are insurance agents must first be familiar with the provisions of the regulation and circular described above. Necessary and detailed explanations are also available on the web page prepared by the "Insurance Directorate" established within TOBB, at www.sigorta.org.tr.
Preliminary Application and Procedure
What companies must do before submitting a preliminary application to our Chamber:
- The applicant completes the Trade Registry and Chamber registration.
- The applicant submits the preliminary application through the TOBB-AEKS Web Page and obtains the preliminary application number given by the system and the register registration number to be used after the application is approved.
- The applicant obtains from the Chamber or the Chamber's web page the list of documents required according to the nature of the application, the application petition and the application form (agent or expert); for insurance agents, Annex 2, the Annex 3 undertaking and the Annex 4 information form; and for experts, the Annex 2 undertaking and the Annex 4 information form.
- The preliminary applications submitted by insurance agents are verified by us against the documents brought in and approved by following the steps in the TOBB-AEKS software program.
- At this stage, a visit is made to the company's address to determine whether the workplace meets the minimum physical requirements, the necessary checks are carried out and a report is drawn up. Preliminary applications of companies that do not meet the minimum physical requirements are not approved.
- Applications of individual experts and register registration procedures are carried out by the TOBB Insurance Directorate.
- The data entry in the TOBB-AEKS software program concerning the company's preliminary application is approved by our Chamber's officials through the system, and at this stage it is sent to the TOBB Insurance Directorate.
- The TOBB Insurance Directorate reviews the preliminary application through the system and, if it finds it appropriate, forwards it through the system to the Undersecretariat of the Treasury. The preliminary application is approved with the approval of the Undersecretariat of the Treasury, and the applicant follows its status at www.sigorta.org.tr.
- After the Treasury's approval, the company pays the determined register registration fee into the designated bank account within six months and sends a copy of the receipt to TOBB. Once the bank receipt reaches the TOBB Insurance Directorate, final approval is given and the company's register registration is completed.
- After the registration in the register is completed, the applicant must, again within six months, obtain an agency from an insurance company and add its agency to the register record. Otherwise, the register registration is suspended.
- For the information to be collected electronically for natural persons, legal entities and technical personnel, you need to review Annex-5, Annex-6, Annex-7 and Annex-8 forms.
