On Social Media Posts in Violation of Legislation
Dear Member,
In the information provided by the Ministry of Trade, it was stated that businesses trading in real estate and motor land vehicles must act in accordance with the legislation when sharing advertisements on social media platforms.
In this context, the following points must be observed in advertisements shared on social media platforms such as Instagram, Facebook and TikTok:
Posts must include the link to the advertisement verified through the Electronic Advertisement Verification System (EİDS).
The photographs, videos and descriptions used in the post must be consistent with the real estate or motor land vehicle that is the subject of the verified advertisement.
The information that is mandatory in advertisements under the Regulation on Real Estate Trade and the Regulation on the Trade of Motor Land Vehicles must be included.
In advertisements shared on social media, the price of the real estate or vehicle must be stated.
As a result of inspections carried out by the Ministry, a total of TL 7 million in administrative fines was imposed on 70 real estate and car dealership businesses found to have shared advertisements in violation of the legislation. Thus, the number of businesses penalized to date has reached 152, and the total amount of fines has reached TL 15.2 million. In addition, administrative fines were also imposed on social media platforms that did not fulfil their obligations under EİDS.
It is strongly announced that our members should prepare their social media advertisements in accordance with the legislation in force, in order to avoid administrative sanctions and to prevent consumer grievances.
